The U. S. Food and Drug Administration (FDA) has granted a temporary restraining order for a potential class action against Johnson & Johnson’s pharmaceuticals giant, Merck & Co. and its American operations. This action is part of the ongoing litigation surrounding the FDA’s ability to block the generic drug industry from receiving approval to market for a new indication for heartburn.

The action has already been heard in individual federal courts, but the FDA has not yet announced a decision. While the agency says it will consider the pending lawsuit, the FDA does not expect to hear back until the end of the year.

In an email to The Associated Press, FDA Commissioner Michael D. Anderson stated, “The Food and Drug Administration is in the midst of a lengthy process that has resulted in a very lengthy and potentially dangerous review of the drug industry and the FDA.”

The FDA, a federal agency that regulates the industry, is currently reviewing and approving a generic version of Pfizer’s blockbuster painkiller Celebrex, a painkiller approved by the FDA in 2002. However, the FDA will likely continue to pursue any action against Merck, Johnson & Johnson or their American operations. The FDA has also recently announced that it is considering a class action against Johnson & Johnson to challenge the drug’s approval of generic versions of the painkiller Bextra.

If successful, the class action could include more than 100 lawsuits filed against Merck and Johnson & Johnson in federal court in New Jersey. The suit could also include thousands of other cases, and the FDA, as part of its efforts to block generic drug manufacturers from making the drugs available to consumers. The agency may also seek to intervene in the pending class action, and hold the companies accountable for the harm they have caused.
